Foreign Affairs Minister Marty Natalegawa said on Wednesday that Indonesia’s decision to abstain for the UN General Assembly’s approval of the global arms trade treaty came from its objections to the treaty’s draft, which required exporters to assess the human rights records of their potential buyers.
“Indonesia’s stance on this matter is clear. We support the idea on the need of a treaty to manage or regulate the international trade of weapons,” said Marty at the State Palace.
“But the problem is, the draft treaty that was brought to the UN General Assembly for voting yesterday contained a concept of conditionality in which arms exporters should assess the human rights conditions in the buyer countries,” he added.
However, Marty denied that Indonesia was worried about the international perception of the country’s human rights record and that this could hamper its arms procurement with its trading partners.
“Our concern was that the draft treaty would allow exporter states to unilaterally assess whether a country upholds human rights principles and they would use it to determine the country’s eligibility to buy weapons. It is very one-sided,” said the Minister.
According to Marty, the authority to make such an assessment would only belong to “a neutral group which contains eminent persons with relevant expertise for the assessment”.
Marty said Indonesia hoped that the treaty could accommodate the establishment of such a neutral group.
The resolution, which regulates the international trade in conventional arms, received 154 votes in favor. Three member states – Iran, North Korea, and Syria – voted against the decision. Indonesia joined 22 other countries that abstained. (ebf)

UK Hawks deal shrouded in secrecy

After months of evasion and deceit, it is now confirmed that British Aerospace has effectively concluded a deal to sell 24 Hawk aircraft to Indonesia. A second deal for 20 more Hawks will be signed before the end of this month.

Indonesia announced earlier this month that it intends to purchase no fewer than 144 Hawk aircraft to equip six squadrons of 24 aircraft each. At an average price of $11 million each, 144 Hawk aircraft will cost Indonesia well over $1.5 billion.

Shrouded in secrecy

Despite categorical denials from British Aerospace today, TAPOL is convinced that the deal has already been finalised. The secrecy shrouding this deal is proof that both the company and the British Government know how sensitive it is and have deliberately sought to mislead the public and avoid protest. This deal will make the UK Indonesia's leading arms supplier, bolstering the war machine of a regime that has illegally occupied East Timor since 1975 in defiance of ten UN resolutions adopted by both the General Assembly and Security Council. The Indonesian armed forces are also waging operations against armed resistance in West Papua and in Aceh, North Sumatra. In the latter region, several thousand people have been killed in operations since 1990.

A minister at the Defence Ministry claimed in Parliament this week that „The point of selling Hawk aircraft to Indonesia is to give jobs to people in this country. There is no doubt in my mind that a Hawk aircraft can do nothing to suppress the people of East Timor“. This amounts to a monstrous deception. According to Jane's Defence Weekly, [9.1.1993], each squadron will be supplied with two-scat trainers and single-scat Hawks to provide reconnaissance and close cover for troops. With military operations under way in so many parts of the country, the role of acrial reconnaissance is clearly crucial.

Speculation that a deal was concluded began last September when Indonesia's air force chief-of-staff, Air Marshal Siboen, said he signed the deal at the time of the Farnborough Air Show last September. British Aerospace told TAPOL that this was a Memorandum of Understanding only about training facilities. On 27 October, Minister for Defence Procurement Jonathan Aitken said the training facilities would „only become valid if a contract for the sale is concluded“. Siboen said on 30 December that „12 Indonesian pilots and mechanics to crew the aircraft have undergone intensive training in Britain“. It has also been confirmed by industry sources in the UK that Indonesian technicians have been training here for the new Hawks for some time. If training is underway, the contract is clearly in operation.

Siboen and the air force

Air Marshal Siboen, the AURI (air force) chief-of-staff is known as a high-flier. The former personal pilot of the president, he has a close relationship with the top executive which has made all the difference for the poorly-equipped air force. Before 1965, AURI was known for its strong ties with President Sukarno. After the military take-over the AURI was heavily purged. Suspicions about the loyalty of the air force persisted and Suharto deliberately kept it small and under-funded. It is Siboen himself, not Habibie, supremo of the country's military industrial complex, who has made all the public pronouncements about the Hawks deal. The sudden emergence of Marshal Siboen and the revitalisation of AURI has led to speculations among political analysts in Jakarta. Suharto, an army man himself, is increasingly at odds with army generals and is garnering loyalty from the other forces, AURI, POLRI (the police) and ALRI (the navy). It is the navy and the air force that are now shopping around and making huge arms deals. According to The Independent [6.XII.1992], the Indonesian regime was secretly negotiating with a private British arms dealer for the purchase of five large scrap combat vessels from the former Soviet Union and seeking to purchase two submarines. The regime has also just taken delivery of 39 naval vessels from the former East German navy.

The link between human rights violations and development aid is gaining acceptance worldwide. This is also the case with arms purchases. It is an outrage that a country like Indonesia with tens of millions living far below the poverty line, indulges in the luxury of purchasing Hawks. It would take an industrial worker in Jakarta, earning the minimum wage of Rp. 3,000 a day, 25,177 years to be able to buy one Hawk aircraft.

While the 1993/94 state budget announced by Suharto in January was considered cautious, defence expenditure rose by a dramatic 18.8%.

A Thatcher affair

A special aspect of Britain's relationship with Indonesia was highlighted recently when Margaret Thatcher received the 1992 honorary fellowship award from the Association of Indonesian Engineers. The first foreigner to receive the annual award, Thatcher was chosen because of her contribution to enhancing UK-Indonesian cooperation in technology, said the Association's chairman, B.J. Habibie. He is also President-Director of Indonesia's aerospace industry, IPTN, and of all the country's other weapons companies.

Aerospace technology was one area where cooperation flourished during Thatcher's period of office. Mrs Thatcher told Tempo that she has worked closely with Habibie for many years. During this period, British Aerospace business with Indonesia has grown by leaps and hounds, including the sale of Hawks, Rapier missiles and BAe's funding of a college of technology in East Java. Menteri Luar Negeri Marty Natalegawa mengatakan pada Rabu bahwa keputusan Indonesia untuk abstain untuk persetujuan Majelis Umum PBB dari senjata global perjanjian perdagangan berasal dari keberatan atas rancangan perjanjian, yang dibutuhkan eksportir untuk menilai catatan HAM pembeli potensial mereka.
"Sikap Indonesia tentang masalah ini jelas. Kami mendukung gagasan tentang perlunya suatu perjanjian untuk mengelola atau mengatur perdagangan internasional senjata, "kata Marty di Istana Negara.
"Tapi masalahnya adalah, draft perjanjian yang dibawa ke Majelis Umum PBB untuk pemungutan suara kemarin berisi konsep persyaratan di mana eksportir senjata harus menilai kondisi hak asasi manusia di negara-negara pembeli," tambahnya.
Namun, Marty membantah bahwa Indonesia khawatir tentang persepsi internasional terhadap catatan hak asasi manusia negara itu dan bahwa ini bisa menghambat pengadaan senjata dengan mitra dagangnya.
"Kekhawatiran kami adalah bahwa rancangan perjanjian akan memungkinkan negara-negara pengekspor secara sepihak menilai apakah suatu negara menjunjung tinggi prinsip-prinsip hak asasi manusia dan mereka akan menggunakannya untuk menentukan kelayakan negara itu untuk membeli senjata. Hal ini sangat sepihak, "kata Menteri.
Menurut Marty, wewenang untuk membuat penilaian semacam itu hanya akan menjadi milik "kelompok netral yang berisi orang-orang terkemuka dengan keahlian yang relevan untuk penilaian".

Hon CHRISTOPHER FINLAYSON: The media reporting in the Jakarta Post, which I presume the member is referring to, is wrong. The Minister has received no advice on the design, timing, and funding of the project. There will be an announcement when a decision is made. There is no project yet for journalists to consider visiting. What could be simpler than that?
Catherine Delahunty: Keeping it simple, will he raise the issue of military and police violence against West Papuans at the Pacific parliamentarians' conference in Wellington this week?
Hon CHRISTOPHER FINLAYSON: New Zealand continues to raise the situation in partnership with the Indonesian Government bilaterally and in multilateral fora, including at the United Nations' Universal Periodic Review of Indonesia.
Catherine Delahunty: I raise a point of order, Mr Speaker. I appreciate the Minister's answer, but my question was very specific: will he raise this issue at the conference in Wellington this week, the Pacific parliamentarians' conference?
Mr SPEAKER: The Minister may like to add to that, but my interpretation was there is a multinational forum and they continue to raise the issue. But if the Minister wanted to add to that, it would be helpful.
Hon CHRISTOPHER FINLAYSON: As I have said, the Minister continues to raise these issues in various multilateral fora. Whether it will be raised by the Minister at the conference to which the member refers, I cannot say.

Dari sejarah kemerdekaan untuk negara Indonesia yang berkedudukan di Jakarta semenjak 17 Agustus 1945 sampai hari ini telah menjadi satu pemerintahan yang penuh dengan para bandit, dan itu adalah nyata dimata rakyat Indonesia sebagai warga negara Indonesia itu sendiri.

Kepentingan golongan untuk Partai Politik, dan kepribadian itu sangat diutamakan, dari pada memperhatikan rakyatnya tentang kemakmuran hidup rakyat sebagai bangsa dan negara Indonesia. Kegagalan pemerintah Indonesia di Jakarta dengan segala sistem yang dijalankan adalah kegagalan yang selalu disembunyikan oleh mereka kepada dunia internasional, semua kegagalan dalam memperhatikan rakyat itu terjadi oleh karena akibat dari Korupsi (Pencuri) hasil kekayaan alam sebagai "APBN (Anggaran Pendapatan Belanja Negara)", dimana APBN ini pun adalah hasil kekayaan alam dari kepulauan-kepulauan di bekas jajahan Belanda, seperti di Maluku, Timur-Timor (sebelum kemerdekaannya), Papua Barat, dan lain-lainnya di bahagian Asia pada geografisnya, seperti di Kalimantan (Borneo), Sulawesi (Celebes), Aceh, dan lain-lain. Tetapi kekayaan alam itu diambil banyak oleh pemerintahan Indonesia di Jakarta itu adalah dari Pulau-pulau di bagian Pasifik.

Kesejahteraan dan kemakmuran rakyat itu adalah tergantung dari sistem yang baik yang mana harus disalurkan oleh pemerintah di Jakarta sebagai kebijakan negara di Indonesia, dimana dukungan fasilitas dan segala kebutuhan perspektif kemakmuran hidup rakyat itu perlu diperhatikan dengan adil dan merata di seluruh kepulauan-kepulauan, dan bukan hanya di pulau Jawa semata, tetapi kenyataan juga bahwa rakyatnya di pulau Jawa pun tidak diperhatikan dengan seksama, dan hal ini adalah masalah bagi mereka di pulau Jawa itu sendiri. Tentunya bagi tiap bangsa di kepulauan-kepulauan lainnya pun merasa cukup dengan tindakan kebijaksanaan pemerintahan Indonesia di Jakarta dengan segala kriminalitas mereka, dimana pemerintahan di Jakarta telah melanggar beberapa kaitan hukum di Indonesia, yang mana tercantum pada hukum UUD 1945. Sedangkan pelanggaran dari pemerintah Indonesia di Jakarta pada hukum internasional pada kaitannya dengan HAM, yaitu: Tentang hak-hak rakyat telah diabaikan, dan penuntutan secara demokrasi pun telah dianiaya oleh aparat keamanan tanpa alasan dari aparat kemanan dengan tepat.

Lebih dari pada itu, bangsa-bangsa di bekas jajahan Belanda otomatis lebih menderita, akibat dari politik dan sistem sandiwara dari segala macam aspek kehidupan yang nyata dilihat dari kenyataan permasalahan dari tiap perspektif itu sendiri, sehingga penuntutan kemerdekaan dari tiap bangsa pada perbedaan kepulauan dari tempat perspektif dan sejarahnya itu sendiri, senantiasa mencoba merebut kemerdekaan mereka, yang mana telah dirampas oleh pemerintahan di Jakarata sebagai pemerintahan kolonial yang tidak mempunyai moralitas.

Contoh sebelumnya pada Timur-Timor sebelum kemerdekaannya, tentunya akibat dari keserakahan, dan segala sifat dan sikap politik dari pemerintahan Indonesia di Jakarta yang tidak mempunyai moralitas itu sendiri yang membawa batas dari kesabaran hidup dari tiap bangsa untuk menghentikan kejahatan pemerintahan di Jakarta dalam kolonialisasi mereka, sehingga perjuangan dalam penuntutan kemerdekaan pada bangsa Timur-Timor selalu diperjuangkan sampai pada kemerdekaannya di tahun 2000.
Tentunya dalam kebersamaan dari hal itu pun tetap dilaksanakan oleh setiap bangsa lainnya secara seksama juga, seperti contohnya Pada bangsa Maluku, Papua Barat, Aceh, dan lain-lainnya sesuai dengan penjelasan kejadian pada perspektif permasalahan masing-masing yang mana dibawah jajahan dari pemerintahan Indonesia di Jakarta sebagai pemerintahan kriminal/bandit.

Di Indonesia sistem peradilan
